Family Law is an umbrella term that includes all issues that affect families. This includes divorce, child custody, child support, petitions for protection from abuse, guardianships, conservatorships, name changes, adoptions, wills, and more. In Mobile, Alabama, different types of family law matters may be heard in domestic relations court, juvenile court, or probate court.
If you and you spouse cannot agree, a contested divorce may be your only path. You must file a complaint for divorce with the court and your case is eventually set for trial so the judge can make the ultimate decision in your case.
The fastest and least expensive way to get a divorce is an uncontested divorce. But uncontested means that you and your spouse have to agree on all of the terms, from child custody to the division of assets and debts.
Child Custody includes any case where minor children are involved–the Court must determine custody and visitation rights for the parents. In cases where the parties are resolving their case by agreement, such as an uncontested divorce, the Court still must make sure that the resolution promotes the best interests of minor children.
Child support is a necessary part of any case involving minor children, which might be a divorce case, a case where two parents have a child together but are not married, or even a dependency case where custody is given to someone who is not the biological parents, such as a grandparent or other relative.
In Mobile, the juvenile court has specific jurisdiction over certain types of family law cases. If child custody is an issue and the parents have never been married, those cases are heard and decided in juvenile court. If the person filing for custody is not the biological parent of the child, this is called a dependency case, which typically means child abuse and/or neglect is involved. These types of cases are heard in juvenile court as well.
